Abstract
法律与道德的关系是西方法哲学长期争论不休的一个焦点，然而法律与道德的本质联系决定了对法律进行道德批判的可能性。法律作为制度的道德这一命题为法律的道德批判提供了批判的前提公设。也正是从这一前提公设出发，不断地对法律实践进行批判揭示了法律的实践理性，从而使法律实践最大限度地符合我的全面自由发展与完善这一根本尺度。
