Abstract
“自主主体论”是美国哈佛大学的哲学家托马斯?司堪伦（T. Scanlon）提出的一个有 关表达自由的理论原则。与众多的从表达的内容、场所和表达的方式等角度讨论表达自由的哲学 理论不同的是，司堪伦教授是从表达的接受者是不是一个平等的、有理性的、自主主体这一角度 来分析问题的，独树一帜。对我们在实际工作中如何判断怎样的表达是违法的这一问题有一定的 参考价值。 [The theory of “autonomous agent” original in a way , which proposed by T. Scanlon, a famous philosopher of Harvard Uni., concerns the theoretical principles of freedom of expression mainly. The theory is established from the perspective of agent, which means to whom a expression is, which is different from theories from perspectives such as of content or place, to which is of high value for us to make reference, when we want to justify whether an expression is against the law or not. ]
