Abstract
从人权角度来看,罪犯的权利本质上是一种少数人的权利、一种弱势群体的权利和一种宪法性的基本权利。罪犯权利保护要遵循权利推定原则、义务法定原则、克减明示原则和特别保护原则。在宪政意义上,罪犯权利的保护程度不仅是一个国家人权保护状况的衡量标尺,而且还是一个国家是否达至法治状态的重要标志。
