Abstract
"Em publicações anteriores, se propôs a ideia dos referenciais (e não apenas de “princípios”), como subsídios para a deliberação bioética, embasando a opção de valores. Nesta linha foram a seguir analisados os “referenciais” da prudência e da vulnerabilidade. Aborda-se aqui o referencial da equidade. Estabelece-se a relação e a “dissimetria” entre igualdade e equidade, tomando, como ponto de partida, para buscar o significado da equidade, a conceituação de Aristóteles (Ética a Nicomaco). Estabelece-se a relação da equidade com a justiça, considerando-se , segundo a visão aristotélica, que a equidade é uma espécie de correção da própria lei quando ela é deficiente. Analisa-se também a “relação” entre equidade e privilégio, assinalando-se que seria absurdo a equidade levar a uma situação de iniquidade. Comenta-se o referencial da equidade na visão liberal (individualista) e na visão comunitária, alertando para os riscos do maniqueísmo. Comenta-se também a importância do referencial da equidade na deliberação e na opção bioética em outros campos, além do das políticas de saúde. Ao se invocar o referencial da equidade para a opção bioética é preciso levar em conta também a “etiopatogenia” (com vistas à correção) que levou a uma situação que torna necessária a aplicação da equidade, pois como referia Aristóteles, “o equitativo é justo, superior a uma espécie de justiça, não a justiça absoluta, mas ao erro proveniente do caráter absoluto da disposição legal”" ["In previous publications, we proposed the idea of ground principles (and not only of “principles”) as a contribution to bioethical deliberation, grounding the option for values. In this same vein we analyzed the “ground principles” of prudence and vulnerability. Equity as a ground principle is discussed in this paper. We established the relationship and the “dissymmetry” of equality to equity, taking as a starting point the search for the meaning of equity, the conceptualization by Aristotle (Ethics to Nicomacus). We established a relationship of equity to justice, considering according to the Aristotelian conception that equity is a kind of correction of laws when these are deficient. The “relationship” of equity and privilege is also analyzed and we point out that it would be very irrational for equity to lead to a situation of iniquity. Equity as a ground principle for a liberal conception (individualistic) and a communitarian one is explored, and we warn about the risks of Manichaeism. We also discuss the importance of Equity as a ground principle for bioethical deliberation and choice in fields other that of health policies. When we talk of equity as a ground principle for bioethical choice, it is necessary to approach also the “etiopathogeny” (in order to propose a correction) of a situation which makes it necessary to apply the ground principle of equity, for, as said Aristotle, “the equitable is just, and better than one kind of justice – not better than absolute justice, but better than the error that arises from the absoluteness of the statement”"]
