Abstract
宪政是西方国家的产物。人性的预设是宪政的基础，即从人性恶的基础上产生了宪 政；宪政的终极关怀是为了人性，即为了人性的自我完善，为了人性的真正自由。从人性的双 重性来考虑和分析宪政——以人性恶的预设来对待执政者，以人性善的视角来关怀民众，从这 两个方面来分析宪政都是必要的。
