行政检举:走向一种新的行政忠诚 [Offense-reporting in Administration - Striding towards a new kind of Administrative loyalty]

Abstract
行政忠诚是官僚组织对官僚个体的最基本要求,同时也是官僚组织得以存在和正常 运行的制度保障。然而在政治实践当中,行政忠诚却发生了异化;在多元主义的泛化以及后现代主 义的角色多元化的影响下,在组织利益和公众利益发生对立的情况下,作为官僚个体面临着严重的 忠诚困境。而后现代主义思想的兴起使得组织与公共利益这一对抗性的利益主体的对立更为严重。 笔者以为,行政忠诚困境并非不可解决,主张个体应树立积极维护作为公共利益受托者的义务,并 从伦理学、新制度经济学和公共选择理论三个纬度提供了构建行政检举的制度体系的思路。 [Chief bureaucratic organization is loyal to the basic requirements of individual bureaucrats. There is also bureaucracy and to ensure normal operation of the system. But in political practice, the Chief loyal happened alienation; Generalization of the pluralism and diversity of the role of post-modernism, organizations and public interest in the confrontation occurred, as a loyal bureaucrat individuals facing serious difficulties. The rise of modern ideas and then makes this confrontation with the main interest of the public interest even more serious confrontation. I believe that loyalty that is not an administrative settlement. actively advocate individual should establish the obligations entrusted with the protection of the public interest and from the ethics, New Institutional Economics and Public Choice Theory spotted three administrative latitude to provide for the building of systems thinking. ]
