Abstract
"Este artigo pretende investigar o sentido e a ligação dos conceitos de pessoa e de justiça a partir das reflexões do filósofo do direito brasileiro Miguel Reale. Sua concepção, o historicismo axiológico, fornece interessantes elementos para a compreensão do Direito como intersubjetividade ordenada. A pessoa é o valor-fonte que orienta historicamente os demais valores que importam para o pleno desenvolvimento humano. A justiça, por sua vez, é o valor-meio, a condição transcendental que possibilita a atualização axiológica da pessoa na coexistência, por meio dos limites que impõe às liberdades em sociedade. Pessoa e justiça são, assim, valores complementares, inseparáveis conceitualmente" ["This paper investigates the meaning and connection of the concepts of person and justice from the theory of the Brazilian philosopher Miguel Reale. His axiological historicism provides interesting elements to the understanding of Law as normative intersubjectivity. The person is the source value that historically guides other values that matter for full human development. Justice, on the other hand, is the transcendental condition that allows for constant axiological improvement of person in coexistence, by placing limits on liberty in society. Person and justice are therefore complementary values, conceptually inseparable"]
